Because the Geneva Convention doesn't apply to these douchebags. They are not legal combatants so they are not subject to the protections offered by the Geneva Accords.

More lies.
The Bush administration has agreed to apply the Geneva Conventions to all terrorism suspects in U.S. custody, bowing to the Supreme Court's recent rejection of policies that have imprisoned hundreds for years without trials. http://www.washingtonpost.com/wp-dyn/content/article/2006/07/11/AR2006071100094.html

Where is your proof that waterboarding has occured since that time?
On top of that, the Geneva Accords where revised in 1949. Laws that where used in war crimes trials of WW2 are not applicable to todays laws.

As far as proof it took place...Is a confession by the Vice President enough ?
WASHINGTON - Dick Cheney, US vice-president, has endorsed the use of "water boarding" for terror suspects and confirmed that the controversial interrogation technique was used on Khaled Sheikh Mohammed, the senior al-Qaeda operative now being held at Guantánamo Bay. http://www.msnbc.msn.com/id/15433467

I'm not seeing a date there dumbass. Where is the proof that it occured after 2006? The man was captured in 2003. Show documentation that they waited 4 years to start interrogating him.
And for the record, Water Cure and Water Boarding are two differant things. The Japanese where convicted for using Water Cure, which forces the captive to consume large amounts of water in a short period of tiem, which leads to gastric distentation, water intoxication, and potentially death.

Listen dumb fuck, the use of waterboarding has never been legally outlawed by our country. It is still a legal means of interrogation. Bush AGREED to adhere to the concepts of the Geneva Convetion for the detainees after 2006. Anything that happened to the detainees prior to that cannot be prosecuted by such. Even though he agreed to it, Water Boarding is still recognized as usable by the United States, because it is not a recognized form of torture.
Your basis that the Japanese where convicted for the use of waterboarding is wrong, because they where convicted for the use of Water Cure, which I already explained is rather differant.
So wail and piss and moan all you want, your not proving a damn thing. Waterboarding has never been declared illegal by the United States Government, and as such is a legal means of interrogation. This may, and is likely to change in the future, but thats not now, or then. What happened is in the past has been legal, and despite the incessant whining of toads like you, has helped to keep your ungrateful ass safe from having more planes parked up it.
