Malawi Court Bars New Madonna Adoption

A man outside Malawi’s High Court on Friday, where a judge ruled that Madonna may not adopt a second child from the country, because she has not lived in Malawi for the past 18 months.

A court in Malawi ruled on Friday that the American singer Madonna cannot adopt a 3-year-old girl named Chifundo “Mercy” James, since the pop star has not lived in the southern African nation for the last 18 months, as Malawi’s adoption law demands.

As The Associated Press explains, Malawi’s High Court decided that the country should not bend the rules for Madonna a second time:

The residency rule was waived in 2006, when Madonna was allowed to take her adopted son, David, to London before his adoption was finalized in 2008. It was not clear why Judge Esme Chombo ruled differently Friday. Another judge had handled Madonna’s previous adoption case.

The BBC adds that the judge suggested in her ruling, which was read aloud outside the court on Friday, that there were other issues besides the residency rule. Allowing Madonna to adopt a second child from Malawi might encourage the trafficking of orphans, she wrote: “By removing the very safeguard that is supposed to protect our children, the courts by their pronouncements could actually facilitate trafficking of children by some unscrupulous individuals.”

The BBC also reported that Madonna was not in the court to hear the ruling and that it was not clear whether she would appeal.

The Malawi government favored granting the adoption. The country’s information minister told Reuters on Thursday that Madonna had helped in the country and was a worthy mother who was supporting over 25,000 orphans in the country.

Opposition to the adoption was led by a group of non-governmental organizations called the Human Rights Consultative Committee, which issued a statement on Wednesday titled “Redefining the Boundaries Between Child Adoption and Child Kidnapping.” The statement said Malawi could and should take care of its own orphans: “We should not create a picture that the state has failed to care for children and therefore that orphans should be taken away from their communities to other countries.”

There are plenty of kids in the U.S. for her to help.

I could even find her some from her home state! 8-12 year olds have the hardest time getting adopted, and she can afford all the therapy, medical care and tutoring that lots of them need (although the state subsidizes those expenses for foster kids over 3 who are adopted). Toddlers and babies are usually adopted by relatives or foster parents. Most kids who have been moved around have behavior problems, which makes adoption more difficult, but they are still great kids-they just do extreme things to see if the foster or adoptive parents will still love them unconditionally.

Police roadblocks prevented reporters from approaching the airport but one police officer also says Madonna carried David, her adopted Malawian son, up the steps to the plane.
"Excuse me, Miss Madonna? There are literally thousands of American babies you could adopt..had you ever thought of trying that, maybe, instead of trying to BUY a baby?"

The singer's lawyer has said that she will appeal against a court ruling that she is not eligible to adopt a 3-year-old orphan girl because she has not lived in Malawi. Bottom feeders at work.

There is a little difference between Angelina/Brad's adoptions and Madonna's. Angelina and Brad are continuing to have their own kids, they want to raise a big family of kids in the same age range together, and they have the money to do it. Since they don't want to turn to science to achieve this, they are adopting.

With Madonna, it seems different because her bio children are not in the same age-range as the babies she's adopting, and if she's not past menapause, she's pretty close to it.

On the other side, there's George Lucas, who has more money than the Pitts and Madonna put together. He fosters and adopts children from California's foster care and adoption systems. He doesn't make a big deal about it, he just does it.

For the rich, it may be easier to deal with foreign adoptions-less red tape, quicker process, etc. There are more subsidies for adopting american kids, but lots more red tape, too.
