DOVER, Del. (AP) — The head of the agency charged with enforcing Delaware’s alcohol laws has resigned after being arrested for drunken driving.

Siobahn Sullivan submitted her resignation letter to Secretary of Safety and Homeland Security Lewis Schiliro on Friday, saying she was resigning effective immediately as director of the Division of Alcohol and Tobacco Enforcement.

Sullivan was stopped for speeding early Thursday on Route 1 near Lewes and subsequently charged with drunken driving. The 45-year-old Sullivan was released pending arraignment, which is scheduled for Oct. 22., and had been placed on administrative leave with pay.

Sullivan is a retired state police sergeant and was the commander of the executive protection unit assigned to former Gov. Ruth Ann Minner.

Some cop in Austin murdered a teenager by shooting him in the back (brown teens get shot a lot around here). It was caught on tape and run on the news. He was acquitted and everyone was in an uproar.

Turns out even if our justice system fails from time to time, he still got his judgement, because he later developed an alcoholism problem and finally got arrested for DWI and taken off active duty.

From what I saw, the Police thought they saw a gun, the man ran TOWARD the police and the Police shot him. The ultimate goal for the Police is to go home at the end of their shift without having to injure or kill anyone. If you were not on the Jury, if you are not involved and if you have never been placed in a situation where you have to make such a decision you really don't know.

Part of the reason the Officer may have developed an Alcoholism problem is because it is hard to deal with killing someone no matter what the circumstances are. I wish he would have had more support after the incident, he might still be on the job.

Officer Siddiqui took a position nearby the front passenger area while officers Quintana and Hitzelberg went to the rear driver’s side to approach the rear passenger, Nathaniel Sanders II.

Quintana opened the door and observed Nathaniel Sanders II. Officer Hitzelberg was standing behind Quintana at this time.

Quintana began attempts to awaken Sanders. When Sanders did wake up, he grabbed Quintana’s hand.

Quintana then pulled up Sanders’ tee shirt and saw a handgun tucked into the waistband of Sanders’ pants

Both Sanders and Quintana reached for the handgun, briefly pulling back and forth for control of the gun.

Sanders leaned back and away to maintain his control of the gun.

Quintana moved quickly backward, away from the door, and alerted his fellow officers that there was a gun.
This is clearly heard on the video when Quintana says, “Pistol, 32, 32.”

Quintana moved to the rear of the Mercedes and across the back end of the vehicle, firing three times. Two of the shots entered the back windshield of the Mercedes and the third entered the right rear window of the Mercedes. The first shot struck Nathaniel Sanders II in the left shoulder in the front of his body.

The second went thru the vehicle and lodged in the front control panel.

The third struck Sanders in the left rear portion of his head.

During this time, the front passenger, Sir Smith, awoke and came out of the front passenger seat. He ran, in a crouched position with his hands at his waist, between the vehicles and directly toward officer Quintana, who was still backing away.

As Smith ran toward officer Quintana, Quintana fired twice more. One of these struck Smith in the left upper chest, traveled down his torso and exited his body. The second shot struck the trunk of the vehicle parked next to the Mercedes but did not hit Sir Smith.

The investigation revealed that there were five shots during the incident and all five were fired by officer Quintana.

A handgun with one live round of ammunition was found on the left rear passenger seat where Nathaniel Sanders had been located.

AUSTIN (KXAN) - An independent review of the Nathaniel Sanders police-involved shooting is complete.

Parts of the report by KeyPoint Government Solutions were made public today. The 133-page document focused on Officer Leonardo Quintana's shooting of Nathaniel Sanders in May 2009 and the investigations that followed.

The heavily-redacted report said parts of the Austin Police Department investigation were biased towards officers and there were "substantive deficiencies." They also cited "significant deficiencies in the quality of documentation relating to training of APD officers." Despite the bias the study found, they felt the "facts developed by the IA investigation combined with those developed by the homicide investigation to be such that our independent investigation did not need to resort to a first-party reinvestigation of those facts."

The Travis County Grand Jury previously declined to indict Quintana. The report also quantifies its analysis.


June 2, 2009: Sanders' family filed a lawsuit against the City of Austin and Quintana. The suit claimed:

•inadequate supervision of officers regarding their use of force
•employing excessive force against minorities
•inadequate warning systems to weed out potentially dangerous officers
•failing to adequately investigate use of force by APD officers
•improperly training officers on how to approach sleeping citizens and inadequate training natch. NAACP, Dem politicians looking to get reelected, tort lawyers swarming like chummed sharks. like a fucking script these days.


AUSTIN (KXAN) - A federal court made a split ruling on Friday in the case involving the death of Nathanial Sanders, Jr.

Then-Austin police officer Leonardo Quintana shot and killed Sanders on May 11, 2009.

Sanders' parents filed lawsuits against both Quintana and the City of Austin following the shooting.

In the split ruling, a federal judge dismissed the case against the city but ruled the suit against Quintana could go forward. The trial date has been scheduled for July 19.

A Travis County grand jury cleared Quintana of any charges related to the Sanders shooting but was later fired from the police force after a drunk driving arrest and a subsequent investigation .

We reached out to Sanders family attorney Adam Loewy for a comment on Saturday, who said they will not be talking at this time but did describe Friday's ruling as a huge victory.

He said it is positive for even a portion of the lawsuit to move forward.

AUSTIN (KXAN) - More than a year after a former Austin police officer shot and killed 18-year-old Nathaniel Sanders, the Austin City Council will not pay the family of Sanders $750,000.

The vote continues a pending lawsuit against the former officer, Leonardo Quintana, who was fired from the force by Police Chief Art Acevevedo after a DWI arrest.

Originally, the city of Austin was part of the lawsuit but was later dropped from the suit. Now the lawsuit will go forward with the city liable for any damages awarded to the Sanders Family.

Council member Chris Riley offered an alternative motion that would have shrunk the settlement to $500k. That proposal drew gasps from the large crowd that gathered to watch the council discuss the issue. Local NAACP President Nelson Linder quickly stormed out of the council chambers, clearly disgusted.

"You want to pick a fight, you got one now, you got one now," said a furious Linder while he stood in the foyer at city hall in front of a mob of media. "We got the Department of Justice, we got the D.A.'s office. We're gonna get these sons of you know what's."Because every circus needs a good clown act.

You do realize that the video shows the cop backing up as the perp charges him, don't you? Throw in the shout of "drop it" and you have grounds for acquittal. That you take pleasure in the officer's anguish over this incident is a far greater indictment of you than it is of him.

I just spent a bit of time googling for police shooting stats in Austin and found nada. If this were a trend, there'd be stats available. Wei is pronouncing the police guilty until proven innocent, something that he accuses them of doing.
