Judge in Porn case has bestality flick on web page

SAN FRANCISCO (AP) - Alex Kozinski is more accustomed to appearing on lists to fill U.S. Supreme Court vacancies than headlines involving pornographic scandals.

But on Wednesday, the chief judge of the country's largest federal appeals court was forced to suspend an obscenity trial he was presiding over after sexually explicit images posted to his personal Web site became public.

The Los Angeles Times reported on its Web site that Kozinski had posted sexual material on his personal Web site and then blocked access after being interviewed about it Tuesday evening.

Kozinski, 57, told the Times he thought the material on his site, which included a video of a man cavorting with a sexually aroused farm animal, couldn't be seen by the public. The judge said he didn't believe any of the images were obscene.

"Is it prurient? I don't know what to tell you," he told the newspaper. "I think it's odd and interesting. It's part of life."

He then suspended until Monday the trial of Ira Isaacs, who is charged with obscenity for selling movies depicting bestiality and extreme fetishes involving feces and urination. Appellate judges such as Kozinski occasionally handle trial court cases.

Kozinski told lawyers in the case he wanted to give them time to consider whether to ask that he be disqualified. Federal prosecutors were discussing their options, Department of Justice lawyer Kenneth Whitted said.

Not my life. Why do people do this stuff? I can understand being a perv but I can't understand collecting the evidence and putting it out the Internet. :eek:

Who appointed him in the first place?

Kozinski was born in Bucharest, Romania, Europe. In 1962, when he was 12, his parents, both Holocaust survivors, brought him to the United States.
Kozinski's first judicial appointment was as chief judge at the newly formed United States Court of Federal Claims in 1982.In 1985, aged 35, Kozinski was appointed to a new seat at the Ninth Circuit by Reagan .

Kozinski has won admirers across the political spectrum who praise what many admirers feel to be "common sense" decisions and his libertarian instinct. As an essayist, his writing is clear and often humorous, and has been featured in mainstream publications such as Slate, The New Yorker, The New Republic and National Review. He also has a reputation as an active and sometimes intimidating questioner during oral argument. Because English is not his native language, he spoke for years with a strong accent which was often surprising to lawyers who are familiar only with his distinctive writing style.

Appellate judges in the United States occasionally hear criminal cases at the District Court level, when they have free time on their calendar, and by chance he was given United States v. Ira Isaacs, a pornography case which will be based on the 1973 Miller v. California case. Ira Isaacs is accused of distributing videos depicting bestiality and other images. During the trial, on June 11, 2008, the Los Angeles Times reported that Kozinski had "maintained a publicly accessible Web site featuring sexually explicit photos and videos" at www.kozinski.com.

Kozinski "acknowledged in an interview that he had posted the materials, which included a photo of naked women on all fours painted to look like cows and a video of a half-dressed man cavorting with a sexually aroused farm animal." It also included images of masturbation and public and contortionist sex, a slide show striptease featuring a transsexual, a series of photos of women's crotches as seen through snug fitting clothing or underwear, and content with themes of defecation and urination.Kozinski agreed that some of the material was inappropriate, but defended other content as "funny."

Stephen Gillers, a New York University law professor who specialises in legal ethics, said Judge Kozinski should recuse himself because "the public can reasonably question his objectivity" about the issues at hand.

Professor Gillers, who has known Judge Kozinski for years and called him "a treasure of the federal judiciary," said he took him at his word that he did not know the site was publicly available. But he said the judge was "seriously negligent" in allowing it to be discovered.

"The phrase 'sober as a judge' resonates with the American public," Professor Gillers said. "We don't want them to reveal their private selves publicly."

He also said he planned to get rid of a step-by-step pictorial of a woman shaving her pubic hair.

Judge Kozinski said he must have accidentally uploaded those images to his server while intending to upload something else. "I would not keep those files intentionally," he said.

The site was never meant to be public, Yale Kozinski said. #"The fact that it was publicly accessible actually is my fault, too," he said.
