Waterboarding has never been declared illegal by the United States Government, and as such is a legal means of interrogation. This may, and is likely to change in the future, but thats not now, or then. What happened is in the past has been legal, and despite the incessant whining of toads like you, has helped to keep your ungrateful ass safe from having more planes parked up it.
