It is a trick question, because President Bush did not "go around" FISA!
He exercised his authority to initiate surveillance while his representative agencies prepared the documents to go before the FISA courts.
The failing resulted from the many leaks of information, forcing the Administration into a damage-control mode.

Thats not true. They were not preparing requests for all the wiretaps....simply not true.
