Roberts says courts cannot set election rules, only legislatures can

so does this mean the SCOTUS, being a court, cannot overrule states?

So what am I missing? These idiots seem to think this is a BIG slam on President Trump.

    Or something like that.

    2. But what's he telling Brett Kavanaugh?
Sounds to me like he said the same thing as Brett Kavanaugh. It's up to the state legislature to set ELECTION LAW, not judges or some other leftist official that wants to give Democrats more opportunities to cheat the system.

    4. Just like that. There goes Trump's evil plan.
What part of ELECTION RULES do they not understand? They seem to think that he is saying that the Supreme Court cannot intervene if states are not conforming or obeying their election rules and laws.

    5. Did he just contradict Kegger Kavanaugh's statement

    about WI ballots?

    14. Only huge if he can get four others to agree with him...

And, right now, he only has the three liberals, with Justice Handmaid having not stated her position yet.

    8. Kavanaugh (along with Gorsuch, Alito, and Thomas) says...

...that, when the state elections involve federal office, that state courts cannot intervene, but federal courts can. Makes no sense to me, but that’s the “beauty” of being on SCOTUS – if you can get five votes for your position, it doesn’t have to make sense.
Right. Because there's no difference between a liberal state court saying, OH SURE, you can count ballots for a week after the election and if there's no postmark on it it's OK to assume it was mailed by the deadline..........and a federal court saying.....NO, the state legislature said that ballots must be in by the end of the day of the election to be counted. Or something.

    24. I think this is not good.

Legislatures of red states with a blue popular vote could just ignore that popular outcome if they don't like it and the courts won't allow challenges.

    26. Sounds like Roberts is going to save us.

The Court can act if the law isn't being followed.

Like what happened in 2000 when Florida wanted to do a fifth recount ( when all the other four came out the same).

If the election laws are unconstitutional, yes. If the election laws do not violate the USC, no. Because 10th Amendment.

They have no problem reading the right to abortion written in invisible ink in the Constitution.

Until the dems pack the courts and burn the constitution.
