    McDonald's shooting victim wants workers compensation

    UPDATE: Police release name of supsect in McDonald's shooting

    FOX16 News obtained surveillance video of the attack at a McDonald’s on Rodney Parham that left an employee with multiple gunshot wounds. The August 2008 video shows a man wearing a white shirt hitting a woman. Seconds later, an employee runs in to break it up and the attacker is forced outside. Off camera, the employee was shot three times. He walks back inside and then collapses before medical attention arrives.

    Six days after the attack, LRPD detectives arrested Perry Kennon, 27, charging him with shooting Nigel Haskett. After three surgeries, $300,000 in medical bills and six months recovery, Haskett filed a workers compensation claim for his injuries.

    Claims specialist Misty Thompson with insurance company Ramsey, Krug, Farrell and Lensing responded, denying Haskett's claim.

    "We've denied this claim in its entirety, it's our opinion that Mr. Haskett's injuries did not arise out of or within the course of his employment," a portion of the statement reads.

    Philip Wilson is Haskett's attorney. He says the defense from McDonald's insurer is baffling.

    "Seems like any employer would want a disturbance stopped and that's what this young man was simply trying to do," Wilson says.

    Wilson says he is now seeking a hearing before the Workers Compensation Commission.

    Seems pretty easy, keeping the peace inside the store is at least somewhat related to his job duties, and he should be allowed Workers Compensation benefits.

    As contrasted with this case, where I think the company was right in denying the death benefit claim. And the employer probably saved a lot of face by paying the woman anyway. Well, not really, since the original case was widely publicized and the subsequent action by Dollar General barely made a sound in the press.

    the guy needs to get his , they would give to anyone who cheated and got hurt or faked an injury

    Not really. It sucks for the guy, but he wasn't injured as a result of the job he was hired to do, or the working conditions at his place of employment.

    More legal reason not to bother doing good for your fellow man. Just what we need. We already have to worry about the person needing help playing possum to rob or kill you, getting sued for beating up or shooting a well deserving criminal, now if it's at work, you may lose your income. Just remember folks, that which hits the fan is not evenly distributed.

    I was thinking more along the lines of this one

    We are supposed to help those in need, defend the defenseless, ect, but between lawsuit happy lawyers and cradle to grave socialists not wanting to do anything their darn selves, being able to gets hard and harder all the time. Even the worldly results like this story, where this poor guy is being punished for coming to the assistance of a customer show that. According to the lawyers and the libs, he should have called 911 and let the professionals handle the situation. Of course, by the time they got there the needed professional would likely be an undertaker, but so what?

    Yes, this hits so many of my buttons it ain't even funny. I get to complain about the lawyers, the lazy and the liberals, all in one fell swoop. :D

    McD's should make this right; and the guy deserves a friggin' medal.

    Side note: Had this employee been armed and stopped the guy, would they fire him like they fired the guy who worked at Pizza Hut and used his gun? I'm interested to know McDonald's policy on personal protection; I know when I worked as a delivery driver we had to sign a release saying we wouldn't carry any personal protection device of any kind, not even mace.

    Mrs. Liebeck got $640,000 from McD's because she burned herself with a cup of coffee but they won't pay for his medical care? I would sue McD's. They failed to provide a safe work environment and subsequently he was severely injured. Actually, anything to get the case in front of a jury. :mad:
