If a driver accidentally strikes and kills a pedestrian, and that pedestrian is an illegal alien in the country illegally, should the driver be prosecuted?

And before you answer, keep this in mind.... technically had the immigrant not broken the law first (by coming and staying in the country illegally) there would not have been anyone on the street.
