WASHINGTON (Reuters) - The U.S. Army staff sergeant accused of the massacre of 16 villagers in Afghanistan on Sunday was treated for traumatic brain injury after being in a vehicle that rolled over in Iraq in 2010, a U.S. official said on Monday.

The official, speaking on condition of anonymity, said it was premature to state whether there was any link between the 2010 injury and the Afghanistan incident.

The Army, just like any huge bureaucracy, usually makes changes post-incident. My experience is that when something happens, there follows an investigation followed by recommendations. Those recommendations don't necessarily fix the problem, but it does give the appearance of "doing something."

I suspect the army will investigate and recommend "prohibiting TBI Soldiers from combat zones."

And that is why a US soldier should not be turned over to civilian "authorities" for acts in uniform, ever.

The issue I have with the Americans calling for his prosecution (and presumptive conviction) is that they think that we should allow a vassal state to try an American soldier. Have they lost their fucking minds? We are Rome, we don't let vassals try Roman citizens.

That may be a mitigating factor, and the court martial will take it into account.

Okay, that right there makes me think he shouldn't get the death penalty as somebody suggested or even necessarily life in prison. We're not sure what state his mind was in. :(
