Police are investigating an apparent Occupy Wall St. protester’s online threat to kill cops.
Someone with the Twitter handle “smackema1” tweeted this message at 11:39 p.m. Saturday, following a clash at Zuccotti Park.: “we wont make a difference if we dont kill a cop or 2.”
The tweet was directed to a page on Ustream showing live footage of the protests.
The writer was had tweeted several comments about the protests Saturday night.
The NYPD is seeking a subpoena to find out who’s behind the Twitter account, according to Paul Browne, the department’s top spokesman.
Protesters attempted to stay overnight in the park Saturday, after their encampment was booted out Nov. 15.
“We had planned on being there for 24 hours,” said protester Aaron Black, 38, of Williamsburg, Brooklyn. “They were using their clubs and beating the crap out of people.”

In all fairness, it's probably an accurate statement in the sense that I don't think the movement will make one bit of difference as it is right now. That being said, it will probably make the opposite impact to what the tweet was implying/intending. If the occupy protestors escalate to that level of violence, the local LEOs will take off the gloves. Maybe they'll call in the National Guard. It's not going to be pretty, and people will likely get shot. See: Kent State Riots. With occupy, there will be far, far more injuries and deaths on the protestor side of things than the LEO side of things if it came to blows. I'm just not quite sure what politically this gains them.

The statement is callous and stupid, but it's not really a threat. It's not actually plotting or threatening to kill cops. Any trial would probably end in aquittal.
Legally speaking, it'll be interesting to see if NYPD can get a warrant for the Twitter account from a NYC judge.
