SEC. 3.(a) It is the intent of the Legislature to enact legislation that would, except when otherwise not permitted by federal law, ensure that everyone in the state has the right to all of the following:
(1) Access to income sufficient for survival, regardless of employment status or criminal justice background, including, but not limited to, the right to receive funds through public welfare programs, private donations, collecting recyclable goods, or soliciting donations in public spaces.
(2) Safe, decent, permanent, and affordable housing, as soon as possible, and the right to be free from further dislocation, unless and until safe, decent, permanent, and affordable housing is available.
(3) Access to clean and safe facilities 24 hours a day, seven days a week, with clearly identifiable staff able to react to safety concerns, including, but not limited to, shelters and drop-in centers that meet basic health, hygiene, and dignity needs, including any special needs of lesbian, gay, bisexual, or transgender individuals, youths, families, or those with mental illness or physical disabilities. This includes the right of all individuals to secure shelter without being required to state their gender or to share confidential health information protected by the federal Health Insurance Portability and Accountability Act of 1996 (Public Law 104-191).

How could any state possibly afford to enforce this? Is Starhawk writing CA legislation now?
Starhawk is a Wiccan author, she wrote a novel envisioning a future in which all of the nation is controlled by fundamentalist Christian extremists and San Francisco is a separate environmentally correct paradise that provides for all who live there, whether they want to work or not. Cal. years ago passed a amendment years ago that said that any one can submit any law and it must go on the ballot for voters to decided. If passed they can do nothing but follow through with it. Its part of why Cal is so screwed up now. Any idiot can submit any law idea and it must be voted on by the people.

Basically. From each according to his ability and to each according to his need, as Marx plagiarized from another author. But the implications of this are always fun to examine. You see, we cannot determine ability. We can guess at aptitudes, or rate prior performance, but the capacity to accomplish things is unknown. Similarly, need is also not determinable. The best that you can do if you are dividing up resources based on "need" is to give everyone an equal share, regardless of accomplishment. This means that there is no material incentive to be productive, since everyone gets the same pittance, no matter what, and since ability is immeasurable, output is limited to what it takes, not to improve your condition, since it cannot be improved, but to avoid sanction or punishment. Thus, communism can be summed up a people doing just enough to avoid punishment and still get fed. Most cultures call that slavery.
