Obama Skips Past Congress Again With Health Mandate Delay

A constitutional law professor at George Washington University said that Obama “has been far more aggressive in circumventing Congress and far more successful in creating an imperial presidency” than Bush.

President Barack Obama’s latest legal end run around Congress — delaying enforcement of the employer health mandate — has sparked more questions about whether he’s abusing his executive discretion under the Constitution.

The move announced late Tuesday was the latest in a string of decisions where the president, facing a divided Congress unable to get much done beyond keeping the government running, has taken matters into his own hands.

Where a previous president might have asked for a legislative fix if a mandate was proving too onerous for business, the Obama administration put out a couple of blog posts saying that, in listening to the business community, it decided not to enforce a key part of the 3-year-old health law for another year.

The administration notes that parts of laws are delayed in implementation all the time — including various pieces of the tax code.

If a Republican decided to rule by decree, the outrage would be off the scale.

Analytically speaking, that was a smart move to make on behalf of his fellow Democrats up for re-election next year.

No doubt, but so would suspending the Constitution and decreeing that the senate will remain at the current breakout of Republicans or Democrats. The point is that it's illegal.

I'm not so sure. If the Republicans are smart (Doubtful, I know) they can make it three times the bogeyman it might really have been and an admission of Obamite failure. It is the employer mandate that is delayed, not the individual penalty, after all. The shitheads that vote for Obama would have blamed their employer (If any) for any turbulence about the employer mandate, not Obama, now the GOP is free to exaggerate its pending horrors as egregiously as the Obamites exaggerated its benefits in getting it passed.

The problem with this is that when Republicans tell the truth, they are accused of lying by the media and Democrats, while when Democrats lie, the media pretends that they are telling the truth (the most egregious example was Candy Crowley's transformation from moderator to debator during the Benghazi discussion in the presidential debates). Any Republican exaggerations would be picked apart by the left's fact checkers, and this would put the Republicans on the defensive. It's better to tell the absolute, unvarnished truth about Obamacare and the individual mandate, and force the media and the Democrats into hysterical denials.
