Judge again rules for Trump administration in fight for control of CFPB

    Source: Washington Post

A federal judge on Wednesday sided with the Trump administration for a second time in a fight for control of the Consumer Financial Protection Bureau, denying a request by a high-ranking agency employee that she be put in charge instead of the White House’s pick.

U.S. District Judge Timothy J. Kelly on Wednesday turned down Leandra English’s request for a temporary restraining order that would prevent White House budget director Mick Mulvaney from serving as the CFPB’s acting director. “English has not demonstrated a likelihood of success on the merits or shown that she will suffer irreparable injury absent injunctive relief,” Kelly said in the 46-page ruling.

    ...

English’s attorneys have argued that the 2010 Dodd-Frank Act, which established the CFPB after the financial crisis, laid out a specific plan of succession authorizing the deputy director to take over until a White House nominee is confirmed by the Senate. Also, they said, Mulvaney cannot wear two hats by simultaneously leading the independent financial regulator while serving as director the Office of Management and Budget.

“We are disappointed in today’s decision,” Deepak Gupta, English’s attorney, said in a statement. ”The law is clear: President Trump may not circumvent the Senate confirmation process by installing his White House budget director to run the CFPB part time. Mr. Mulvaney’s appointment undermines the Bureau’s independence and threatens its mission to protect American consumers.”

Good, the CFPB is just one more agency Obama/liberals corrupted for their partisan use. It's time to clean it up and hold those responsible to account. And liberals HATE that thought.

    1. So can the WH rename it the Consumer Financial Exploitation Bureau/Corporate Protection Bureau?

Might as well just shut the whole thing down and just get rid of all those pesky consumer protection regulations. Buyer beware. No more do not call lists. Give tax incentives for scamming seniors. Arbitration only clauses overseen by corporate panels. Self policing and policy making by the financial industry. MAGA
No, but they'll be looking to see who the liberals - which is all they'd hire - exploited for their partisan gain and do something about it.

    2. Sooooooooooooooooooooo

while this fascist was leading the charge on the tax scam, to basically screw everyone making less than $75,000 a year, so that congress can go after social programs with "his" CBO score, this asshole, is now been given the green light to complete the total screwing....................................

We now have judge(s), sitting on the bench that apparently cannot read a law that says there is an order of succession:

“We are disappointed in today’s decision,” Deepak Gupta, English’s attorney, said in a statement. ”The law is clear: President Trump may not circumvent the Senate confirmation process by installing his White House budget director to run the CFPB part time. Mr. Mulvaney’s appointment undermines the Bureau’s independence and threatens its mission to protect American consumers.”

November 2018 cannot get here fast enough
LOL. Because there were 2 ways outlined of succession and they are siding with the way President Trump chose to do it.

However there was NO alternative way to interpret the fact that the President can decide who can come to the US and who cannot. He has that authority. And the left is fine with activist judges who either cannot read and understand clearly or are willing to play to their temper tantrum throwing side.

The law is clear. That's why the Progs keep losing this case. This agency has a track record of shaking down financial companies to extract money. And that money was then used as a slush fund for cronies and Prog political groups. The agency needs to be neutered and eventually euthanized - put out of its corner of the economy's misery.
    Facts don't matter to DUpipo.

Note to "Warpy" and "shockey80": I voted for Donald Trump! I would do so again!
